By downloading, installing, or using CarbSmart AI ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.

CarbSmart AI is a dietary tracking application designed to help individuals with diabetes estimate carbohydrate content in meals using AI-powered image recognition, barcode scanning, and food search. The App provides nutritional estimates and is not a substitute for professional medical advice.

CarbSmart AI is NOT a medical device and is NOT intended to diagnose, treat, cure, or prevent any disease or medical condition. All carbohydrate estimates, insulin suggestions, and nutritional information are approximations for informational purposes only.

Always consult your healthcare provider, endocrinologist, or registered dietitian before making changes to your diabetes management plan, medication dosages, or diet.

The developers of CarbSmart AI assume no liability for any health outcomes resulting from use of the App.

You agree to use the App only for lawful purposes and in accordance with these Terms. You are responsible for:

• Verifying carbohydrate estimates with your healthcare provider

• Not relying solely on the App for insulin dosing decisions

• Keeping your device secure and not sharing your subscription with others

• Providing accurate information when using the App

CarbSmart AI offers a free tier and a premium subscription ("CarbSmart Premium"). Premium subscriptions are billed through Apple App Store or Google Play Store.

• Monthly subscription: auto-renews monthly

• Annual subscription: auto-renews annually

• Lifetime purchase: one-time payment, no renewal

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. All refund requests must be submitted to Apple or Google directly.

The App and its original content, features, and functionality are owned by CarbSmart AI and are protected by international copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the App without our express written permission.

To the maximum extent permitted by applicable law, CarbSmart AI and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of health outcomes, loss of data, or personal injury, arising from your use of the App.

Our total liability to you for any claims arising from use of the App shall not exceed the amount you paid for the App in the twelve months preceding the claim.

We reserve the right to terminate or suspend your access to the App at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last Updated" date. Your continued use of the App after changes constitutes acceptance of the new Terms.

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
